En d&#8217;autres termes, il permet \u00e0 une propri\u00e9t\u00e9 (dominante) de faire un pas pour une autre (serviteur). Mais ce droit n&#8217;est pas automatique : il exige qu&#8217;un titre constitutif et une inscription au Conservateur immobilier (CBR) soient opposables.<\/p><p>Par cons\u00e9quent, m\u00eame si un chemin a \u00e9t\u00e9 utilis\u00e9 historiquement, s&#8217;il n&#8217;y a pas d&#8217;enregistrement ou d&#8217;\u00e9criture en vigueur, il n&#8217;y a pas de servitude l\u00e9gale. Cette disposition est express\u00e9ment \u00e9nonc\u00e9e \u00e0 l &#8216; article 882 du Code civil, qui exige le titre de la servitude discontinue telle que le transit. Ce document indique s&#8217;il existe une servitude enregistr\u00e9e. Si elle n&#8217;appara\u00eet pas, elle n&#8217;existe pas l\u00e9galement, m\u00eame si une route est utilis\u00e9e depuis des ann\u00e9es. Cette entente doit \u00eatre traduite en \u00e9crit public, puis enregistr\u00e9e aupr\u00e8s du CBR. Le plan avec les coordonn\u00e9es et la disposition est obligatoire.<br\/><br\/><\/li><li>jugement d\u00e9claratif ou de reconnaissance:<br\/>S&#8217;il y a un arri\u00e8re-plan (comme un ancien titre ou une longue utilisation), la d\u00e9claration de servitude peut \u00eatre requise. Mais sans enregistrement, le proc\u00e8s doit \u00eatre conclu avec un titre qui permet son enregistrement.<br\/><br\/><\/li><li>Proc\u00e8s par verrouillage (art. 847 CC):<br\/>Si la propri\u00e9t\u00e9 n&#8217;a pas acc\u00e8s au public, une servitude l\u00e9gale de transit peut \u00eatre exig\u00e9e, ce qui permet d&#8217;indemniser financi\u00e8rement la propri\u00e9t\u00e9 du serviteur. Cette servitude doit \u00e9galement \u00eatre enregistr\u00e9e pour la validit\u00e9.<br\/><br\/><\/li><li>Demande de protection:<br\/>Il s&#8217;agit d&#8217;une mesure de pr\u00e9caution visant \u00e0 pr\u00e9venir les coupures arbitraires. Votre cible ? Veiller \u00e0 ce que chaque lot r\u00e9sultant ait un acc\u00e8s l\u00e9gal et s\u00e9curis\u00e9.<\/p><p>Principaux changements:<\/p><ul><li>Acc\u00e8s obligatoire aux routes publiques ou agricoles.<br\/><br\/><\/li><li>Les routes int\u00e9rieures (servumes ou lots sur le chemin) doivent \u00eatre gard\u00e9es au prorata par les propri\u00e9taires.<br\/><br\/><\/li><li>Les routes projet\u00e9es sur des avions certifi\u00e9s par le SAG sont comprises comme des servums de transit automatique.<br\/><br\/><\/li><li>Obligation d&#8217;enregistrer ces servums dans le CBR.<br\/><br\/><\/li><\/ul><p>Cela met fin \u00e0 l&#8217;informel dans l&#8217;acc\u00e8s : l&#8217;utilisation ou la tol\u00e9rance ne suffit plus.
